Terms & Conditions

Payment is due on the date of the invoice issued by ZephyrArt.
We reserve the right to charge storage and interest on the amount outstanding at 8% over the Bank of England base rate accruing on a daily basis until all amounts are paid.
We also reserve the right to charge interest under the Late Payment of Debt (Interest) Act 1998.
We reserve the right to suspend services and/or work and exercise a right of lieu over any item in our possession.
We reserve the right to sell any item to offset against any amounts outstanding.
Up until the point of delivery to ZephyrArt at their premises risk will be held by the client and the client will resume the risk once the item has been picked up by the client.
Although ZephyrArt holds appropriate insurance. If an item is of high value it is the responsibility of the client to ensure that adequate cover of insurance is in place.
We reserve the right to hold copyright for any images or designs made by ZephyrArt.
ZephyrArt own all intellectual property rights including but not limited to copyright under registration, Design Rights, Trade Mark in any original images, design, artwork, drawing or painting produced under work.
ZephyrArt grants a non-exclusive licence to the client to use the image provided in the work of private purposes only.
Zephyr Art retains any moral rights in any work.
Depending on the design request by the client, the client warrants that they own the copyright or have the authority of the copyright owner in any design, image or print artwork provided to ZephyrArt.
The customer agrees and accepts that any work undertaken on motorbike helmets or other motorcycle accessories or main body of a bike, which will include but is not limited to painting and lacquering may invalidate the maker of the helmets warranty.

The customer is advised to check their warranty period to handing over the items to Zephyr Art,
Zephyr Art can accept no liability for any damage, loss of warranty as a result of the work undertaken.

LIMITATIONS OF LIABILITY - THE CUSTOMER'S ATTENTION IS PARTICULARLY DRAWN TO THESE CONDITIONS

This condition 1 sets out the entire financial liability of the Supplier (including any liability for the acts or omissions of it’s employees, agents, consultants, and subcontractors) to the Customer in respect of:
1. any breach of Contract;
2. any use made by the Customer of the Services, the Deliverables or any part of them; and
3. any representation, statement or tortious act or omission (including negligence) arising under or in connection with the Contract.
All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the Contract.
Nothing in these Conditions limits or excludes the liability of the Supplier:
1. death or personal injury resulting from negligence; or
2. for any damage or liability incurred by the Customer as a result of fraud or fraudulent misrepresentation by the Supplier.
Subject to condition 2 and condition 3
1. the supplier shall not be liable for:
  1. [loss of profits; or]
  2. [loss of business; or]
  3. [depletion of goodwill and/or similar losses; or]
  4. [loss of anticipated savings; or]
  5. [loss of goods; or]
  6. [loss of contract; or]
  7. [loss of use; or]
  8. [loss or corruption of data or information; or]
  9. [any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses.]
2. The Supplier's total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance, or contemplated performance, of the Contract shall be limited to £2 million.
